1. SCOPE OF SERVICES

1.1 Awakening Purpose provides:

  • Individual hypnotherapy and psychotherapy sessions (in person and online)
  • Group hypnotherapy sessions delivered online via video call services (eg Zoom)
  • Subscription based memberships providing access to live group sessions and recorded content
  • Digital hypnotherapy audio programs and related materials
  • This website and related social media accounts (including Facebook, Instagram, Youtube, X/Twitter and elsewhere)

1.2 All services are provided by Registered Clinical Hypnotherapists who are members of the Australian Society of Clinical Hypnotherapists (ASCH).

1.3 We reserve the right to refuse access to and/or use of our services or this website to anyone for any reason at any time.

1.4 You accept that content may be transferred unencrypted and involve:

  • transmissions over various networks; and
  • changes to conform and adapt to technical requirements of connecting networks or devices.

2. NATURE AND LIMITATIONS OF SERVICES

2.1 Our services are not medical services, and are not a substitute for medical, psychiatric or emergency care.

2.2 Hypnotherapy and psychotherapy outcomes vary between individuals. No guarantees are made regarding results or outcomes.

2.3 Our services are not suitable for individuals experiencing:

  • Psychosis or active delusions
  • Acute suicidal ideation
  • Severe unmanaged mental illness unless cleared by a qualified medical practitioner.

2.4 You acknowledge that emotional responses may arise during or after sessions.

3. CLIENT RESPONSIBILITIES

3.1 You agree to:

  • Provide accurate and complete health and personal information
  • Disclose any relevant medical, psychological or medication history
  • Disclose any current, pending or historical legal proceedings that relate to issues connected in any manner to the matters you seek hypnotherapy/psychotherapy support for
  • Refrain from attending sessions while under the influence of alcohol or non prescribed drugs
  • Follow practitioner instructions and guidance

3.2 If you do come to sessions under the influence of alcohol or recreational drugs or demonstrate violent/abusive behaviour, we reserve the right to cancel the session and refuse any further therapy sessions.

4. MINORS & PARENTAL CONSENT

4.1 We provide services to both adults and minors.

4.2 Services for minors require:

  • A completed parental/guardian consent form
  • Ongoing consent from a parent or legal guardian

4.3 Confidentiality for minors is respected, subject to legal and safety obligations, including mandatory reporting.

4. MINORS & PARENTAL CONSENT

4.1 We provide services to both adults and minors.

4.2 Services for minors require:

  • Ongoing consent from a parent or legal guardian

4.3 Confidentiality for minors is respected, subject to legal and safety obligations, including mandatory reporting.

5. ONLINE SERVICES/ONLINE GROUP SESSIONS

5.1 Online sessions are delivered via third party platforms (including Zoom).

5.2 You acknowledge the inherent risks of online delivery, including technical disruptions and reduced privacy.

5.3 Group sessions:

  • Are confidential but not guaranteed to be private
  • Must not be recorded, shared or redistributed by participants

5.4 We are not responsible for disruptions caused by internet, platform outages or participant environments.

5.5 Awakening Purpose will typically create a video or audio recording of online group sessions (Higher Sessions). For your privacy, before recording starts you will be notified and be given the opportunity turn off video/change screen name.

6. MEMBERSHIPS & SUBSCRIPTIONS

6.1 Memberships are billed monthly in advance via Square.

6.2 You may cancel your membership at any time. Cancellation takes effect at the end of the current billing period.

6.3 No refunds are provided for partial billing periods.

6.4 We reserve the right to modify pricing or inclusions with reasonable notice.

6.5 You must ensure the security and confidentiality of your registration details, including any username and/or Password. You must notify us immediately if they become aware of any unauthorised use of your registered details.

6.6 Where a member service is for one user only, you will not let any other person use your Password or any registered user or member services.

7. DIGITAL PRODUCTS

7.1 OAll digital products are licensed for personal, non commercial use only.

7.2 You must not:

  • Are confidential but not guaranteed to be private
  • Must not be recorded, shared or redistributed by participants

8. INTELLECTUAL PROPERTY, COPYWRIGHT & TRADEMARK

8.1 All material on this Site, in our Awakening Purpose Community or otherwise delivered by us by us including (but not limited to) course content, text, graphics, information architecture and coding (Our Content), is subject to copyright. While you may access, browse or print Our Content for non-commercial, personal or internal business use, you must obtain our prior express written permission if you’d like to use, copy, record or reproduce it. Modification of Our Content for any other purpose is a violation of our copyright and other proprietary rights and is strictly prohibited.

8.2 You acknowledge that you do not acquire any ownership rights by using the Site or Our Content.

8.3 Awakening Purpose is owned by Musketeers Corp Pty Ltd (ACN 161 507 964).

8.4 The trademarks, logos, and service marks displayed on our Site are the registered and/or unregistered trademarks of Awakening Purpose. The trademarks whether registered or unregistered, may not be used in connection with any product or service that does not belong to Awakening Purpose, in any manner that is likely to cause confusion with customers, or in any manner that disparages Awakening Purpose.

8.5 Nothing contained on this Site or in our Awakening Purpose Community should be construed as granting, by implication, estoppel or otherwise, any license or right to use any trade mark without our express written permission.

8.6 You agree that damages may be an inadequate remedy to a breach of these Terms and acknowledge that Awakening Purpose will be entitled to seek injunctive relief if such steps are necessary to prevent violations of its intellectual property rights.

9. BOOKINGS, PAYMENTS, CANCELLATIONS & REFUNDS

9.1 Payments are processed via Square.

9.2 Cancellation, rescheduling and refunds policies apply as per below:

9.3 Digital products are non refundable once accessed, except as required under Australian Consumer Law.

9.4 Nothing in these Terms limits your rights under the Australian Consumer Law. Where a major failure occurs, you are entitled to a refund or replacement as required by law.

10. CONFIDENTIALITY & PRIVACY

10.1 Personal information is handled in accordance with our Privacy Policy.

10.2 Confidentiality may be breached where required by law, court order, or to prevent serious harm.

10.3 Session notes are stored securely in cloud based systems.

11. COMMUNICATIONS & MARKETING

11.1 By engaging our services, you consent to receive transactional emails and SMS messages (eg notification of upcoming appointments etc).

11.2 Marketing communications will comply with the Spam Act 2003 and include opt out options.

12. LIMITATION OF LIABILITY

12.1 To the extent permitted by law:

  • We exclude liability for indirect or consequential loss
  • Liability is limited to resupply of services or refund of fees paid

12.2 We do not make any express or implied representation or warranty about, or shall be liable, in contract, tort (including negligence) or otherwise, for any direct, indirect, special or consequential loss, damages or reliance in connection with any of our Site, Awakening Purpose Community or Our Content.

12.3 In no event will we be liable for any damages whatsoever, including but not limited to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, or the cost of procurement of substitute products or services arising out of or related to the use, inability to use, unauthorised use, performance or non-performance of or reliance upon this Site, Awakening Purpose Community or Our Content.

12.4 These limitations and terms include (but are not restricted to) loss or damage you might suffer as a result of:

  • Reliance on the completeness, accuracy, suitability or currency of information, products or services irrespective of any verifying measures taken by us (including third party material and advertisements).
  • Failure of performance, error, omission, interruption, deletion, defect, failure to correct defects, delay in operation or transmission, computer virus or harmful component, loss of data, communication line failure, unlawful third party conduct, or theft, destruction, alteration or unauthorised access to records.
  • Accessing websites or servers maintained by other organisations through links on our Site, Awakening Purpose Community or products or services. Links are provided for convenience only. We do not endorse linked websites nor their products and services and you access them at your own risk.
  • The use of credit card or other financial information, failure to complete (or delay in completing) any transaction, or other loss or damage arising from any transaction made or attempted on our Site.

13. INTERNATIONAL CLIENTS

13.1 You acknowledge that services are delivered under Australian law regardless of your location.

14. GOVERNING LAW

14.1 These Terms are governed by the laws of New South Wales, Australia, and you submit to the exclusive jurisdiction of NSW courts.

15. DISPUTE RESOLUTION

15.1 If a dispute arises between the parties in relation to these Terms, the dispute must be dealt with in accordance with this clause and any party claiming that a dispute exists must notify the other party to the dispute (Second Party) in writing of the nature of the dispute.

15.2 In the case of claims against us, all notices are to be provided to lucas@awakeningpurpose.com.au.

15.3 If the dispute is not resolved by agreement within five (5) business days of the Second Party receiving the notice referred to above, either party may refer the matter to mediation conducted by a mediator agreed between the parties within a further five (5) business days or failing agreement within that period, as appointed by the executive director for the time being of the Australian Commercial Disputes Centre Limited.

15.4 Once a mediator is appointed, the parties agree that:

  • The costs of the mediator shall be borne equally between the disputing parties.
  • The chosen mediator shall determine the procedures for mediation.
  • The chosen mediator will not have the power or authority to make any other determination in relation to the dispute.

15.5 If the parties have not mediated a resolution of the dispute within ten (10) business days of the selection of a mediator, neither party shall be obliged to continue any attempt at mediation under this clause, and either party may then commence such legal proceedings as it considers fit in relation to the dispute.

15.6 Nothing in this clause prevents a party from commencing proceedings seeking urgent interlocutory relief from a court or tribunal of competent jurisdiction to hear the matter, if, in that party’s reasonable opinion, it is necessary to protect their rights.

15.7 Despite the existence of a dispute the parties must continue to comply with their obligations under the contract.

15.8 This clause survives termination of these Terms.

16. CHANGES TO THESE TERMS

16.1 We may update these Terms from time to time. Continued use of our services constitutes acceptance of updated Terms.

17.1 We welcome enquiries or feedback on our Site. Unless specifically stated by you, we shall treat any information you provide us with, as non-proprietary and non-confidential.
